HIGH COURT DIRECTS TO RELEASE LIFE TERM CONVICT AFTER COMPLETION OF 22 YEARS OF JAIL SENTENCE

Justice M.G.Giradkar at the High Court here has allowed the writ petition filed by a life term convict Sunil Nimbaji Burde and directed the petitioner to be released on completion of 22 years in jail.

         Appearing for the petitioner, Mrs. Deepa Charlewar argued that the petitioner is undergoing life imprisonment with the other co-accused Sachin Taklikar and Motiram Taklikar.  The other co-accused Motiram Taklikar was released after completion of 24 years of a jail sentence.

         The petitioner’s counsel Mrs. Charlewar pointed out to the court that all the three accused have been convicted and sentenced similarly.  However, the petitioner has been discriminated.  The petitioner’s counsel Mrs. Charlewar further pointed out to the court in the case of Sachin Taklikar Vs. The state of Maharashtra, the Hon’ble High Court has allowed the petition and directed to release the petitioner therein after completion of 22 years of imprisonment.

         Considering the report submitted by the Additional Sessions Judge, Nagpur, the Hon’ble High Court has allowed the petition and directed the respondents to release the petitioner by applying clause 3(b) of G.R. dated 10/03/2010.

         Adv. Deepa Charlewar i/b Charlewar associates appeared for the petitioner. Mr. I. J. Damle appeared for the state.
