High Court granted Bail to the accused of smugling of Snake

Justice Pushpa V. Ganediwala at the Nagpur bench of Bombay High Court has directed to release the applicants Laxam s/o of Raju Khirodhar, Shankar s/o Dattu Zete, Pintu s/o Jyotiram Thombare, and Dilip s/o Hirabansi Pawar on their furnishing P R bond in the sum of Rs. 20000 each with one solvent Surety each in the like amount.

The applicants were arrested in Crime No. 20/2016 dated 10/10/2020 registered at  Forest Department, Popatkhed Road, Akot, District – Akola for the offense punishable under Sections 2(16), 9, 29, 31, 35, 39,44, 48(A)(B), 49B, 50, 51(1-C) and 52 of the Wildlife Protection Act, 1972 and Sections 26(1)(i), 52, 61 and 65A of the Indian Forest Act, 1927.

The allegations against the present applicants are that they along with the other co-accused committed smuggling of sand boa snake. The police arranged a trap and some of the accused were caught red-handed along with one sand boa snake and some ran away.

While admitting the applicants/accused on bail, the court observed that the applicant cannot be detained for an uncertain period only because the other co-accused were absconding, and the applicant is in jail for a considerable period.

The High Court directed the accused / applicants to attend the consent police station on every first Thursday of each month between 12 to 2 pm.
