HIGH COURT GRANTED PROTECTION TO THE ACCUSED IN THE CASE REGISTERED UNDER ATROCITIES ACT

Justice M. G. Giradkar at the Nagpur Bench of Bombay High Court granted protection to one Prashant Fokmare the resident of Telhara, the authorized dealer of Hero Honda in Telhara, in the case registered under the relevant provisions of SC & ST (Prevention of Atrocities) Act, 1989.

One Nirmala Santosh Thate lodge the report with the Police Station Telhara in respect of the castiest and intentional insult by the Prashant Fokmare. Based on the complaint filed by Sau. Nirmala Thate, the Police Station Officer Telhara registered the case under the provisions of SC & ST (Prevention of Atrocities) Act, 1989.

The petitioner/applicant Prashant Fokmare approached to the Additional Sessions Court Akot by filing application for grant of anticipatory bail. The learned Additional Sessions Judge Akot please to reject the application on the ground of bar under section 18 of SC & ST (Prevention of Atrocities) Act, 1989.

The Hon’ble High Court while granting protection observed that there is a property dispute and there was a quarrel between the complaint and the applicant.

Adv. Ishwar S. Charlewar, Deepa I. Charlewar and Adv.  Amol P. Borkar appeared for the applicant Prashant Fokmare and APP Shri T. A. Mirza represented State.
