The Hon’ble Justice Shri Z.A. Haq and Hon’ble Justice Shri Avinash Gharote, at the Nagpur Bench of Bombay High Court has issued notices to the Deputy Commissioner of Police (Crime) Branch and Shri Vazir Shaikh, Senior Police Inspector and made it returnable after two weeks, on a petition filed by one Leelabai w/o Nandlal Dixit.
The petitioner alleges that she is the owner of 47000 sq. ft. of land situated at mouza- Bokara, P.H. No.171/1. The said land was inherited by the petitioner through her mother Sitabai Patvi.
The respondents- Manoj Jaynarayan Sharma, Sameer Pralhad Sharma and Prashant Surendrakumar Sahani by submitting the false documents, claims to be the owner of the property. The petitioner alleges that the respondent no.6- Shri Vazir Shaikh who is the Senior Police Inspector, without there being any authority put the lock on the premises of the petitioner- Leelabai Dixit.
Though the competent Civil Court has passed the injunction in favour of the petitioner, however the Senior Police Inspector Shri Vazir Shaikh has not returned the keys to the petitioner and every alternate day asking the petitioner to attend the Police Station on enquiry it reveals to the petitioner that same is being done by the orders of Deputy Commissioner of Police, Zone No.5, Nagpur.
