High court issued notices to DIG(Prisons) Nagpur over a death of prisoner

Justice Sunil Sukhare and Anil Kilor at the Nagpur bench of the Bombay high court issued notices to the respondents including DIG (Prisons) Nagpur, Morshi jail superintendent, Jail’s medical officer Kanchan Sonare, in-charge jail SP Ashok Malvad and guards Manohar Pate and Ankush Tejankar. The court directed to file their response within three weeks.

The petitioner Ramesh Kisan Rathod alleged that one of the inmates of Morshi open jail in Amravati died due to negligence of authorities. According to the petitioner, deceased Pradip Gadekar was suffering from some serious ailment.

While issuing notice, the court observed that the issue is serious and raises a question mark on the attitude and the functioning of the prison authorities. The court further tersely observed that if this is allowed to be ignored, other prisoners may face similar tragedies in the future.

The petitioner through his counsel Mr. Mir Nagman Ali prayed for an inquiry in respect of Gadekar’s Death, to be conducted through the District and the Sessions Judge. The petitioner also prayed for the registration of offense under section 304-A of the Indian Penal Code.

  1. Honourable Judges issued notice regarding negligency by Prision Authorities. It is good. Sometimes jail authorities do not honour prisioner’s request to send to proper hospital immdly. Sometimes, they are taking care like cataract operation or regular treatment of AIDS etc.

  2. If you come across such incidents pl inform us so that some positive steps can be taken to avoid such incidents.
