The Hon’ble Bombay High Court has recently issued notices in a Criminal
Writ Petition filed by GLS Electronics Industries Pvt. Ltd through it
Director Brijesh Lohia.
It has been contended by the Petitioner that the property which has been
provisionally attached by the Directorate of enforcement is not out of the
proceeds of crime and the said property was purchased much prior to the
commission of any scheduled offence as alleged.
The Petitioner has also questioned the authority of Registrar/
Administrative officer to issue the show cause notice under Section 8(1) of
PMLA as in view of Section 6(5) of PMLA, the Chairperson of the
adjudicating authority should be a judicial member.
The bench comprising of Hon’ble Justice Reavati Mohite Dhere and Justice
V. G. Bisht, upon hearing the counsel for the Petitioner, pleased to issue the
notices and made it returnable on 20/07/2022.
