High Court of Bombay, Bench at Nagpur issued notices to the Nagpur Municipal Corporation, Nagpur, for non-payment of gratuity amount

Hon’ble Shri Justice R.K. Deshpande & Hon’ble Justice Pushpa V. Ganediwala, at the Nagpur Bench of Bombay High Court, issued the notices for final disposal of the matter, returnable after 8 weeks.

That, one Chandrashekhar Jadhav, the employee of Nagpur Municipal Corporation, Nagpur, came to be retired on superannuation from the post of Chief Fire Officer.


That, since some departmental enquiry was pending against the petitioner, the amount of gratuity has been withhold by the respondent- Nagpur Municipal Corporation, Nagpur. The petitioner came to exonerated from the charges of departmental enquiry by order dated 29/5/2020, however the gratuity amount has not been paid. Upon enquiry, it was revealed that the departmental enquiry bearing No. 14/2013 is pending against the petitioner.  As the petitioner is retired in the year 2011, therefore, no departmental enquiry can initiated after retirement of the petitioner.


Adv. Ishwar S. Charlewar with Adv. Mrs. Deepa Charlewar and Amol Borkar, appeared for the petitioner and Shri H.N. Prabhu, learned Additional Government Pleader, appeared for the respondent no.1- State of Maharashtra.
